THTFHQ Terms of Use, Personal Data Processing, and other Policies

1. General conditions

The Website is exclusively administered by The Hand That Feeds HQ. Its objective is primarily to promote male seiyuu in their music activities as well as provide information on their careers.

In visiting and using the Website, the visitor/user accepts its terms and conditions without any reservations. If the visitor/user does not accept them, they must leave the Website immediately.

The Hand That Feeds HQ, reserves the right at all times to change the presentation and configuration of the Website, as well as its terms and conditions of use and personal data processing policy. The visitor/user should consult these terms and conditions before accessing the Website.

2. Property Rights

All contents of the Website, namely, texts, promotional photos, cover art, graphics, trademarks, logos, advertising, audio or video materials, and web design or any other distinctive signs susceptible to commercial and industrial use, are protected in the general terms of law and by the legislation on intellectual and industrial property, copyright and related rights, and cannot be used outside the Website without the prior written permission of The Hand That Feeds HQ.
Without prejudice to the foregoing, the user may download or copy the contents of the Website strictly for personal use.

Fair-use guidelines:

1. The material must be properly attributed to its original source.
2. The material must be re-written in the words of those who are using the content on The Hand That Feeds HQ. Copy-pasting an entire article is illegal. Quoting an excerpt of an article is permitted.
3. The individual/website that bases its news on the content featured on The Hand That Feeds HQ must have content from other sources as well as its own, original content. If the majority of the content featured on that individual’s/company website is based or a copy of the content featured on The Hand That Feeds HQ, that is illegal and criminally punishable.
4. No verbatim translations are permitted. However, translating excerpts of the articles is permitted. Please refer to Translations (2.5) for more details.

Distributors, manufacturers, publishing companies, and retailers can quote our reviews in publicity material as long as prior contact via “contact us” page has been made with The Hand That Feeds HQ, requiring permission to feature our content in said publicity materials.

The Hand That Feeds HQ reserves the right to later on use those materials for our own publicity campaigns.

There is content on The Hand That Feeds HQ that is copyrighted to Bandai Namco ARTS and its subsidiaries – Lantis, Kiramune, etc. ©Bandai Namco ARTS can be found in articles with copyrighted content to Bandai Namco ARTS and its subsidiaries. It is not permitted to reproduce any content featured on news and reviews that include the ©Bandai Namco ARTS copyright. This does not mean The Hand That Feeds HQ is a part of Bandai Namco ARTS.

Unless otherwise stated, all material published on handthatfeeds.com is owned by and copyrighted to The Hand That Feeds HQ.

Usurpation, counterfeiting, exploitation of usurped or counterfeited content, illegitimate identification and unfair competition are criminally punishable.
The Hand That Feeds HQ reserves the right to take legal action against the authors of any copy, reproduction or other unauthorized use of the content of the Website by third parties.

2.1. News and other content

Please note that some of the content posted on The Hand That Feeds HQ may not belong entirely to The Hand That Feeds HQ and has been posted with the (co)owner’s permission or, if no permission was asked, it is being shared for promotional purposes respecting fair-use policies.

If any of the news posted on The Hand That Feeds HQ violates your rights, please contact The Hand That Feeds HQ via “contact us” page and the content will be removed.

If there are any inaccuracies in the content featured on The Hand That Feeds HQ, please contact The Hand That Feeds HQ via “contact us” page and the error/typo/mistranslation/unclear wording will be corrected.

As mentioned in Property Rights (2), The Hand That Feeds HQ may not be able to give permission to use copyrighted Bandai Namco ARTS content.

2.2. Reviews

All Reviews featured on The Hand That Feeds HQ are copyrighted. The opinions expressed belong to the respective authors. Reviews do not constitute endorsements of the artists or the music labels that promote the artists. No reviews on The Hand That Feeds HQ are commissioned therefore all content is free of bias and external influences.

It is strictly forbidden to make verbatim translations of the reviews featured on The Hand That Feeds HQ. Please abide to the fair-use guidelines in the point above (2).

2.3. Seiyuu Digest

The Seiyuu Digest is an original feature created and developed in 2014 by The Hand That Feeds HQ. Its objective is to share information with readers of the Website about the careers of their favorite seiyuu, shedding a different light on their work.

The Seiyuu Digests are the result of extensive research for accurate facts and credible information from the sources as closest to the seiyuu himself as possible. Japanese seiyuu magazines, interviews on video and radio, events, content from their books (when applicable), and performances (live performances or appearances on radio and TV) are all on the basis of the research done by The Hand That Feeds HQ. No word of mouth or rumors are taken into account in the Seiyuu Digests. No content from any of the sources mentioned above is reproduced in its entirety. Quotes and excerpts, under fair use, are featured in some of the Seiyuu Digests.

The Hand That Feeds HQ reserves its right to not disclose the sources used to write each Seiyuu Digest. When there are quotes or excerpts, there will be a link and mention of the original source.

All photos, cover art, official videos, audio and/or anime stills are used for promotional purposes. That content is the legal property (copyright and/or trademark) of their respective owner(s) where said companies’ or individuals’ rights apply.

In no way The Hand That Feeds HQ aims at spreading false information nor does it spread gossip information. The Hand That Feeds HQ firmly believes that no gossip or personal information of the seiyuu must be shared and will, in no occasion, do that.

If any inaccuracies occur, The Hand That Feeds HQ suggests using the “contact” form to notify the editorial staff of such inaccuracies. If there are inaccuracies, the staff of The Hand That Feeds HQ will proceed to correct those.

All Seiyuu Digests are copyrighted. Using the content of any Seiyuu Digest without crediting it on other platforms such as Wikipedia violates copyright laws.

It is strictly forbidden to make verbatim translations of the Seiyuu Digests featured on The Hand That Feeds HQ. Please abide by the fair-use guidelines in the point above (2).

2.4. Logo and header

The logo and header of The Hand That Feeds HQ Website are copyrighted to Vanessa Silva (midorin), the owner and founder of The Hand That Feeds HQ.

The logo and header of The Hand That Feeds HQ can not be used outside of this Website. Suppose any individual or company wants our press kit. In that case, they must first contact us through the “contact” page stating, if it is a company, which company it is and what it is known for, its official website, and reasons why they want the press kit and how will they use it; if it is an individual, they should state their intentions and where the press kit is going to be used.

The copyright of the press kit provided belongs to The Hand That Feeds HQ, in no way it can be shared on other platforms.

2.5. Translations

Individuals and/or website teams that want to translate excerpts of the news, reviews, and/or Seiyuu Digests must contact The Hand That Feeds HQ through the “contact” page to ask for permission, stating the website/blog in which the content is going to be translated and shared. The Hand That Feeds HQ reserves the right to deny permission to any individual and/or website for any reason.

If permission is given, Translators agree that they will abide by any demands made by The Hand That Feeds HQ on its copyrighted material.

If a Translator does want to do more than 4 translations per month of content featured on The Hand That Feeds HQ, they must ask for permission from The Hand That Feeds HQ via “contact us” page.

Translating excerpts of the news, reviews and/or Seiyuu Digests on The Hand That Feeds HQ does not give the Translator any rights over the content on The Hand That Feeds HQ nor does it constitute a working relationship with and for The Hand That Feeds HQ.

The Hand That Feeds reserves the right to demand the removal of any and all Translations from the website/blog/fan page of the Translator at any time and for any reason as well as revoke permission to the Translator at any given time.

3. Personal Data Processing

With the entry into force on 25 May 2018 in all Member States of the European Union, of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation (GDPR)), it is necessary to publicize this Policy for the Institute’s Personal Data processing, which underpins the commitment of The Hand That Feeds HQ to comply with the rules for personal data protection
This Policy therefore establishes the basis on which personal data obtained or provided by the respective owners are processed by this Website. The term “personal data”, as used in this Policy, refers to certain information such as names, email addresses, or any other information that may be used to identify the holder. It is not necessary to provide personal information to navigate this Website.

3.1 Consent
By registering on The Hand That Feeds HQ Website; and/or providing any personal data, the data subject is freely giving their explicit consent for the submitted personal data to be processed for the purposes and in the terms described in this Policy and per the laws and regulations in force relating to personal data.

The processing of personal data consists of an operation or set of operations carried out regarding personal data or personal data groups by automated means or not namely collection, registration, organization, structuring, preservation, adaptation, retrieval, consultation, use, disclosure, dissemination, comparison, interconnection, limitation, erasure or destruction.
Some personal data must be provided to sign up to receive the latest news on The Hand That Feeds HQ.  The Hand That Feeds HQ will also require some personal data such as age group, gender, and/or location in some of its polls. That information is only used for research and statistical purposes, to get to know our readers and their tastes.

3.3 Data controller
This Website is property of The Hand That Feeds HQ, based in Cascais, Portugal, and responsible for the processing of personal data obtained or provided via the Website www.handthatfeedshq.com. You can also contact us via the “contact us” page.

3.4 Purposes of Personal Data Collection
The personal data collected on the Website www.handthatfeedshq.com is processed with the sole purpose of: registration for the mailing list or participation in polls.
Personal data may also be processed to answer questions, make suggestions, or respond to complaints from the respective data subject.

3.4 Communication and transfer of personal data

All the data will be processed by WordPress (mailing list registration) or The Hand That Feeds HQ (personal data in polls or via contact us page).

No data will be transferred to third-party entities or any sponsors.

3.5 Retention of personal data

The length of time during which personal data is stored and retained varies according to the purpose for which the information is processed.

If a user decides to unsubscribe from the mailing list, their data will be removed from our Website. After gathering and studying the information from polls that may be conducted on The Hand That Feeds HQ, the content of the poll is erased and the personal information is removed from our database.

3.6 Minors

Minors under the age of 16 must obtain parental or guardian authorization before accessing or making personal data available on the Website.

It is the responsibility of the legal guardian or parents to identify content and pages accessed by minors under 16.

3.7 Complaints

Without prejudice to being able to submit complaints directly to The Hand That Feeds HQ. through the contacts made available for this purpose, the data subject can directly complain to the National Data Protection Commission (CNPD), which is the Supervisory Authority in Portugal, via contacts made available by this entity for that purpose.

4. Exclusion of Liability
The Hand That Feeds HQ reserves the right at any time to suspend, modify, or discontinue the publication of all or part of the Website. Visitors/users accept that access to the Website and its channels and services may be terminated at any time, with or without prior notice, and The Hand That Feeds HQ be held accountable for that fact.

5. User participation in Website contents

The Website allows and encourages the participation of its users through commenting on our posts, submitting tips through our “contact” page, and participating in polls and competitions (when applicable).

Users who directly give tips to the Website through our “contact” page may not assume the identity of a third party or misrepresent their identity.

The contents posted by the users directly on the Website are the sole responsibility of their authors and express their personal opinions only, and The Hand That Feeds HQ cannot be responsible for any of them under any circumstances.

Without prejudice to the foregoing, The Hand That Feeds HQ may monitor the contents uploaded directly on the Website by users, reserving the right to edit, refuse to publish or remove or eliminate, totally or partially, contents that in particular:

• Do not comply with these terms of reference;
• Violate any applicable national or international law;
• Contain messages regarded as unlawful, offensive, defamatory, abusive, obscene or discriminatory, of a racial, sexual, religious, or political natural or for questions related to beliefs, nationality, age, or social status;
• Targetted harassment to the staff of The Hand That Feeds HQ or any of its users;
• Violate the rights of third parties, in the fields of personality, author and related, industrial, commercial, or other;
• Constitute “spam”, and “chains”;
• Contain email addresses or websites or HTML tags;
• Have commercial or advertising purposes, or constitute misleading, unlawful or unfair advertising;
• They are not related to the scope of the Website or contain false, ambiguous or misleading information.

The above guidelines, which are not exhaustive, are provided as an example, and The Hand That Feeds HQ reserves the right to alter them at any time.

Without prejudice to liability for damages and losses that may occur, The Hand That Feeds HQ may at any time and without prior notice resolve and terminate its relationship with the user, preventing/blocking his, or her, access to the Website or features, if it detects a use that is not by the provisions of present Terms Of Use And Personal Data Processing Policy or that is unlawful.

6. Privacy

This Website uses ad services provided by Wordads. As it is a staple for WordPress, the ads are non-invasive and do not harm the computer of the user. Ads come from third parties and in no way can The Hand That Feeds HQ control what kind of ads are featured on the Website as those change from user to user taking into account their habits on the web.

7. Links

The Website contains links to websites of music companies, official seiyuu Twitter accounts, and websites, as well as other sources of information that may be of interest to the user. The Hand That Feeds HQ declines any responsibility concerning the information provided by these websites, nor does it have control over the policy of handling personal data and the security of those websites.

8. Changes to the Terms of Use and Personal Data Processing Policy

The Hand That Feeds HQ reserves the right at any time to make adjustments or changes to these Terms of Use and Personal Data Processing Policy, by publishing such changes in its own dissemination methods.

9. Interpretation and Jurisdiction

The interpretation of these Terms Of Use And Personal Data Processing Policy, as well as the resolution of any disputes arising within the scope of the Website, shall be regulated exclusively by Portuguese law and submitted to the exclusive jurisdiction of the Lisbon District Administrative Court.

Other Policies

10. Embargo policy

The Hand That Feeds HQ (“we”, “us”) respects all the embargoes provided that we are contacted by the individual or organization (the “marketing representative”) providing the embargoed material; that the marketing representative contacts us in advance with the embargoed material and we agree to the terms of the embargo.

11. Collaborations

Any company, individual and/or website that wants to collaborate with The Hand That Feeds HQ must first contact us through the “contact” page. The contact must explicitly state the nature of the collaboration, duration (if applicable) and other details deemed important.

Collaborations can include but are not limited to promoting concerts, books, music, events, shared competitions, special VTR content, signed content, and giveaways. All this content must be closely related to male seiyuu and their work.

The Hand That Feeds HQ reserves its right to refuse collaborations with any company, individual, and/or website that does not fit our terms, go against any of our policies, or come from any dubious platform/entity.

12. Sponsors

The Hand That Feeds HQ welcomes the help of our users/readers to make it possible for us to review as much music as we and you want. We accept sponsored copies of music releases for reviewing purposes.

We do not store nor download said music releases (unless stated). After reviewing, the link that was shared with us is deleted and, if any content had to be downloaded due to weak internet connection, it will be immediately deleted from our computers.

The Hand That any music label in Japan does not sponsor Feeds HQ although we are open for partnerships. Please do contact us through the “contact” page if you represent a Japanese music label that produces male seiyuu music or has male seiyuu artists in your roster. The Hand That Feeds HQ would be glad to help male seiyuu gain a bigger fandom and have their projects exposed to Western fans.

13. Ads 

The Hand That Feeds HQ is a pro-bono website (no one working at The Hand That Feeds HQ receives a salary) that relies on ad revenue (ads by Adsense that can be found throughout the website) to be up and running.

The ads displayed on this Website are non-intrusive and reflect the tastes (based on the cookies and history on the computer) of the user. The Hand That Feeds HQ does not have control over what kind of ads appear for each user.

14. Advertising

The Hand That Feeds HQ has 3 footer ad spaces available – ads sized 275px X 200px – and one bottom right main sidebar ad space available 300px X 600px. We welcome HTML ads.

The Hand That Feeds HQ reserves the right to terminate at any time the ad distribution if any ad stops respecting our guidelines and terms & conditions.

15. CDJAPAN

The Hand That Feeds HQ is an anti-piracy website. We promote music and other content and encourage our users/readers to purchase the said content by sharing official links to the online store of the Japanese retailer, CDJAPAN. CDJAPAN does not endorse us but has been affiliated with the company since 2012.

When the user clicks on an affiliated link and completes a successful purchase, The Hand That Feeds HQ receives 4% of that sale. This 4% we earn is not extra money charged to the user instead, it is money awarded by CDJAPAN to the affiliated marketeer for making a sale.

Affiliated links have cookies that stay on for 30 consecutive days. In that period, any purchase made by the user, even if it is not the original item that was clicked on the Website, will generate the aforementioned 4% revenue on the total sale for The Hand That Feeds HQ.

16. Click-bait stance

The Hand That Feeds HQ has a firm stance on today’s trend among news outlets to resort to clickbait to drive traffic to their websites. The Hand That Feeds HQ does not support that behavior and will never act in such a disloyal way to drive traffic to the Website. News will never feature ambiguous, out-of-context titles or use wrong featured images to attract readers.

17. Website language

Although The Hand That Feeds HQ is based in Portugal, the Website is not displayed in Portuguese. All the content on the Website is written in English. Japanese names for songs, TV shows, and other media will be present, however, translated to English between brackets. When reviewing music, The Hand That Feeds HQ always refers to the songs in its “Romanji” reading instead of the Kanji.

Users who are not comfortable with reading English can use the “translate” widget we have on the right sidebar. Select your language and it will translate our website however not accurately. Pay attention that some of our reviews have colloquial speech and it might not translate correctly to your language.

18. Social media

The Hand That Feeds HQ can be found on Twitter, TikTok, Instagram, Pinterest, YouTube and Facebook. Those are the only official accounts we have. If you find The Hand That Feeds HQ in some other social media website please report them to us, as impersonating can lead to criminal charges.

19. Contact page

The contact page of The Hand That Feeds HQ serves as a link between the reader and the Website or the marketing representative and the Website however, The Hand That Feeds HQ reserves its right to not reply or delete, including but not limited to, the following types of e-mails:

• Asking when a review is due or how long is the team going to take to review something;
• Asking for the personal address of a certain seiyuu or fan mail contacts;
• Provide illegal download links;
• Asking us why female seiyuu are not featured on our website;
• Asking why a certain release or collection is not reviewed;
• Demanding changes in the Website to fit their tastes;
• Asking for a certain seiyuu to feature on our Seiyuu Digests; and
• Trying to sell products or services.

Questions on topics already answered or explained on The Hand That Feeds HQ will not be replied.
